We recently had an unfavorable experience with our son’s developmental pediatrician and this is what happened.

Can a doctor refuse a patient?

This is the question that I’ve been trying to answer about two or three months ago. Considering ethics alone, physicians should provide treatment to all those who need it, regardless of gender, race, status in life, or religion.

A one-sided story


    On the other hand, a doctor may refuse to provide services to an individual if there is a conflict between the values and beliefs of the parties involved, such as in cases of euthanasia and abortion, which are both controversial issues.

    The same holds true here in the Philippines. However, in terms of refusing a patient, the statement Is quite broad. According to the Code of Ethics of the Philippine Medical Association, under section 3.9.1, I quote “The physician shall be free to choose whom they will serve, except in cases of emergency.”

    So, yeah. If I understood it correctly, doctors have all the right to choose the patients whom they will serve.

    Was it really refusal?


    I asked the question above because we sort of had a misunderstanding with our development pediatrician and she gave hint that we should find another doctor. To quote the closing statement of her email, “I already sent you the initial report, and now, the reassessment report. Should you need copies again for your next assessment with a different doctor, let us know.”

    Were we really refused further medical services by that doctor? Seems like it because no matter how many times I read that statement, this is how I interpret it – that we should get an appointment with a different doctor for our next assessment.

    Anyway, that sort of disagreement with our doctor was unintentional but apparently, her secretary was an expert in concocting stories, and our good doctor chose to believe her without listening to our side.

    We were tolerant all throughout


    As a backgrounder, we went to her last November 28 for my eldest son’s scheduled check-up. The session went well, as with our first, but since we missed months of therapy for my son, we were told to treat the matter urgently and re-enroll him in a school soon.

    A home-schooling program would be a great alternative instead of a face-to-face session since it was not yet allowed because of quarantine restrictions. Our doctor promised that she will email to us the result of the evaluation in 2 weeks; a critical requirement because the therapist will use that as the basis for my son's custom home program.

    Two weeks passed, then Christmas went by, and we still haven’t heard from her. Naturally, we had to follow up since the results were urgent (as she also kept emphasizing during our session). The secretary, however, told us that she still couldn’t ask the doctor because she had just come from her Christmas break.

    So after a week or so, we asked the Secretary again via SMS if there was any news when we’d receive the evaluation; there was no reply. We called her and still, there was no assurance since the doctor was quite busy, she said, even if we told her that we were due for evaluation from the school in the next few days.

    That went on — the ambiguous or vague replies from the secretary — for days until the very day when Khris & I were due to meet my son’s teacher online. At one point between those days of giving us frivolous replies, the secretary even told us that the good doctor had already emailed the evaluation, she even saw it in the doctor’s sent items, she secretary said. 

    When we told her that both of us didn’t get the document, she asked us again for our email addresses, which we gave her again.

    The day of our online meeting with my son’s teacher finally arrived. That morning before the meeting, I called the secretary again. I asked, in a firm and insistent voice, if there’s any news that they can give us the document. I told them that we needed it for the meeting, I reiterated that it was urgent and that it was ours so we have every reason to demand it.

    In short, no document arrived and we went on with the meeting. My son’s teacher just asked us about what the doctor discussed with us during the session and we told her that the advice was to continue occupational therapy. It was fine, she said and asked us to forward the document once we get it.

    The fateful events that followed


    That very night, I received quite an arrogant email from our good doctor who sent us the document with “apologies” and admittance of their error but with accusations of us being unprofessional and disrespectful and even saying that I intimidated the secretary.

    I thought it was unfair, so I explained my side in detail, even sending screenshots of our SMS conversations and call logs as evidence of her secretary’s lapses. She told us that the secretary would be reprimanded but we heard nothing from her after that.

    During our babies’ regular check-ups with their pediatrician, we told her about the incident. Since she knew the developmental pediatrician personally, she promised that she would talk to her, ask about what happened, and try to explain our side to her.

    Almost a month passed after that incident and we soon learned from our babies’ doctor that the developmental pediatrician would not listen to our explanation anymore. Apparently, she would only choose to listen to a story that arrived to her first and that was her secretary’s lies.

    Epilogue


    It felt like we were discriminated against, to be honest. We felt bad because the incident involved our son and we were nothing but respectful to the secretary. But what can we do, we’ll just have to move on and seek the help of another developmental pediatrician, whom we hope will treat us with fairness.

    1. I'm sorry. This would be frustrating. I hate when you can't find a good doctor. We're a military family so we have to be seen on base, and sometimes it doesn't always go smoothly.

    4. My kids doctor of over 20 years refused to write a prescription for a knee scooter for his injury since we had not made an appointment in the last year. They wanted us to schedule an exam first since we went to the urgent care and not them. So I will be looking for a new doctor for the kids

      This sounds overall like an awful experience. We had an issue with a negligent doctor, and I guess if it isn't a fit for either side, it is good to end the relationship. Sorry you had to go through this.

      I am sorry you went through this. As a doctor in the US, it requires so work to get rid of a patient -- you have to have a good reason that is documented and you have to make sure that the patient has information about another doctor that can care for them. Registered letters and all that. This doc seemed like she just dropped the ball -- bad medicine in any country

      I'm disappointed that a doctor would get emotional over hearsay. Are they not taught to deal with every type of behavior? I have seen doctors getting insulted by patients yet they still attend to those patients because the professional they chose require patience and a forgiving heart.

      I would think a doctor could refuse service, but from what I read they had no reason to refuse you. You were doing what the doctor said to do. Honestly though maybe its a blessing in disguise that you find a new doctor. One that is attentive on the things they say and will do, but most important care about your son's wellbeing. The doctor showed you who they really were and chose to dismiss you and your concerns. Find someone better.
